FULL STORY:  A lot of legal experts are saying “yeah right” to this, but who knows . . .

A man named Jeffrey Piccolo is suing Disney after his wife DIED from a meal she ate at Disney World last year.  She had severe nut and dairy allergies, and the staff at an Irish pub in Disney Springs said her order was safe.  But it wasn’t.

He recently filed a lawsuit.  But now Disney is trying to claim he CAN’T sue them . . . because he signed up for a Disney+ trial membership in 2019.  

The fine print when you sign up says any disputes with Disney must be resolved in arbitration, not in court.  So they’re trying to say anyone with Disney+ can’t sue them for ANYTHING.

Jeffrey also bought tickets to Epcot through their website, and they claim the terms and conditions there would nullify the lawsuit too.

His lawyers are calling it absurd.  They say even if those agreements were universally binding, they wouldn’t extend to his wife, since he’s the one who paid.

It’s not clear how much he’s suing for.  We just know it’s in excess of $50,000, but probably a lot more.

 Both sides will present their case at a hearing on October 2nd.
